Right-wing extremist views of the partner as grounds for termination?

As of today, the Berlin Labor Court is hearing the dismissal protection claim of an employee of the Federal Ministry for the Environment.

An administrative assistant was dismissed on the grounds that her partner supported the right-wing scene and that she herself had made false statements about this during her security check.

The employee worked as an assistant to State Secretary Jochen Flasbarth at the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety. In the course of a criminal investigation against her partner, numerous banners and flyers as well as Nazi devotional objects were found during a house search. As a result, he was dismissed without notice, or alternatively with notice.

According to press reports, the reason for the investigation by the Potsdam public prosecutor’s office was the attack on a refugee meeting place run by the Protestant church in Jüterbog, Brandenburg, in November 2015.

The employees’ action for protection against dismissal was heard today at the Berlin Labor Court. No agreement has yet been reached. It now remains to be seen what the outcome of a new hearing next year will be.
