We are probably not the only ones receiving a lot of calls at the moment. The law firm Waldorf Frommer is sending out warning letters due to the (alleged) use of the Popcorn Time software. They regularly demand 956 euros. 450 euros for the investigation of the copyright infringement, 506 euros for the lawyers.
In addition, you will be asked to submit the enclosed declaration of discontinuance and undertaking. Signing such a declaration without having it checked by a knowledgeable lawyer can have dire consequences. This is because it often resembles an admission of guilt – and you are committing yourself for 30 years! What’s more, not every warning about Popcorn Time is necessarily justified.
Popcorn Time is a file sharing platform!
Many people believe that Popcorn Time is just a streaming platform and that it is legal to use. But this misconception can be expensive.
Popcorn Time downloads films and TV series decentrally via torrents in the background. The user is thus active in a file-sharing network. If they watch a movie on Popcorn Time, they simultaneously offer the movies to other users for download – the risk of warnings is high.
If you receive a warning from Popcorn Time: ask a lawyer!
If you have received a warning about Popcorn Time, this does not necessarily mean that you actually have to pay. Does the IP address not belong to you? Did someone other than you watch the films and could you be held liable? How can I write a suitable declaration to cease and desist? Is the amount even justified?
What you should not do, however: Ignore the warning letter; this can have direct and even more expensive consequences in the form of summary proceedings in court. And further warnings may follow.
