No trademark infringement for products obviously offered by third parties

According to a decision by the Higher Regional Court of Frankfurt am Main, it does not constitute a trademark infringement if several products not originating from the trademark owner are offered on an online sales portal after searching for a third-party trademark. This applies in any case if it is recognizable that these are third-party products. This is the case if all search results with the prominent heading “from …” (each supplemented by different designations from other providers) and the user assigns these designations to the manufacturer and not the seller based on the overall design of the offers (OLG Frankfurt am Main, judgment of 21.02.2019, Ref.: 6 U 16/18).
