“NEYMAR” is null and void

The registration of the trade mark “NEYMAR” is invalid. In December 2012, Carlos Moreira successfully applied to the EUIPO to register the word mark as a European Union trade mark for clothing, footwear and headgear. After football player Neymar Da Silva Santos Júnior (Neymar) successfully applied to the EUIPO in 2016 for a declaration of invalidity of this mark for all goods covered by it, the General Court has now confirmed this decision. Moreira had acted in bad faith when registering the “NEYMAR” trademark. He must have been aware that the Brazilian “NEYMAR” was an up-and-coming soccer player with internationally recognized talent, who was already known in Europe at the time, in particular because of his games for the Brazilian national soccer team (EGC, judgment of 14 May 2019, Ref.: T-795/17).
