When selling coffee capsules (in the decided case “Nespresso”) in packs of ten capsules, the basic price for the coffee powder contained in the capsules must also be indicated. In the opinion of the BGH, the capsules constitute pre-packaging within the meaning of the Price Indication Ordinance (PAngV). The coffee powder offered must be offered by weight due to the statutory labeling obligation. This also triggers the obligation to indicate the basic price in accordance with the Price Indication Ordinance (PAngV)(BGH, judgment of 28.03.2019, ref.: I ZR 85/18).
