What does "international trademark registration" mean?
An international trademark application refers to a situation where trademark protection is to be established beyond Germany. Legally, there are various options available for this: the EU trademark, which provides uniform protection throughout the EU, and international registration under the Madrid System (WIPO/Madrid), which allows protection to be bundled across many individual countries. In addition, national applications in individual countries remain a separate option.
Pathways to International Protection
Union trademark
A uniform intellectual property right applicable to all EU member states. This makes sense for planned or existing use in multiple EU countries, but carries the risk that obstacles in individual countries could have EU-wide repercussions.
International Registration
A process for bringing together many countries under a single administrative umbrella. Applications are filed centrally but are examined in each designated country in accordance with national law.
National Applications
Targeted individual registrations in specific countries. In certain scenarios, these are more robust or predictable than international systems, but require greater coordination efforts.
