Product advertising with the designation “best product” and “product winner” without specifying a reference is not permitted

As with all advertising with test seals and/or test results, a reference must be provided. This should (and must) give the consumer the opportunity to check which criteria were used to arrive at the test result or award. The same applies to the “awards” “Best Product” and “Product Winner”. If the reference is missing, this constitutes a breach of information obligations in accordance with § Section 5a UWG(LG Wiesbaden, judgment of 10.10.2018 – 12 O 29/18).
