VK Cologne: No Corona emergency aid due to private threat to existence

In an urgent decision, the Administrative Court of Cologne ruled that a self-employed person is not entitled to receive €9,000 in emergency coronavirus aid if they claim that their livelihood is at risk. On this basis, it is not possible to claim the emergency aid. The emergency aid provided by the Federal Government is intended to secure the economic existence of the company. However, the applicant had argued that she needed the aid to cover the rent for her private apartment, her health insurance premiums and other living expenses. The court did not accept this justification for the emergency aid. Insofar as the applicant considered her private existence to be at risk, the Administrative Court referred to the application for unemployment benefit II, the application for which was also simplified by the Federal Government (VG Köln, decision of 8 May 2020, ref. 16 L 787/20).
